If after examination of the File and Images, Bank determines that you have processed and transmitted the File in accordance with the Procedures, the File is balanced, and the Images meet the requirements of this Agreement, including the “Scanning of Items and Transmission of Files” section, then Bank shall accept the File (“Accepted File”) for deposit to your Account. Notwithstanding the fact that Bank has accepted the file for deposit, any credit made to your Account shall be provisional and you will remain liable to Bank for any errors, inaccuracies, breach of warranties and any other loss sustained by or claim made against Bank on the part of any party.
